Falk Trial to Resume Monday

The capital murder trial of John Ray Falk Jr., accused of being an accomplice in the death of TDCJ correctional officer Susan Canfield during an escape in 2007, is scheduled to resume Monday in Bryan. The resumption of the trial follows appeals court proceedings which delayed the trial more than a month.

As a result of the appeals process, the prosecution in the case no longer has to include in jury instructions that Falk had to anticipate the exact way in which his fellow escaping inmate, Jerry Duane Martin, would kill Officer Canfield.

Testimony shows that Falk had exchanged gunfire with the officer and was struggling over her rifle shortly before her horse was struck, and she was killed, by a truck driven by Jerry Duane Martin during their escape.

Tomorrow morning District Judge Ken Keeling will meet with attorneys in Bryan to discuss jury instructions and remaining issues before closing arguments get underway Monday.
