New Judge Appointed for Falk Trial

A new judge has been appointed in the capital murder case of TDCJ inmate John Ray Falk Jr., who is accused of being an accomplice in the murder of TDCJ officer Susan Canfield during a prison escape in 2007.

Judge John M. Delaney is the new trial judge, replacing District Judge Ken Keeling who was recused after he declared a mistrial in the case on January 29th. Keeling said he believed the jury could not arrive at an impartial verdict because of a 55-day delay in the trial which got underway in November.

According to Judge Delaney, a date for the next hearing has not been set, but he has talked with District Attorney David Weeks and defense attorneys Kyle Hawthorne and Michelle Esparza. Delaney told them it would be around 90 days before they get back together in court.

The death penalty is being sought for Falk under the Texas Law of Parties.
